Curran, Hollenbeck & Orton, S.C. appeals from a judgment dismissing its small claims action against Jeannine Pemberton and Charles Paulman without prejudice. Curran, Hollenbeck & Orton argues that the trial court erred in dismissing the action and that it is entitled to judgment as a matter of law. We conclude that the trial court erred in dismissing the case. However, we cannot conclude based on the record that Curran, Hollenbeck & Orton is entitled to judgment as a matter of law. Accordingly, we reverse the judgment and remand to the trial court for further proceedings.
